These Terms and Conditions (“Terms”) govern your access to and use of www.insurecapstone.com and any related online forms, portals, email, telephone, and text-messaging services made available by Capstone LLC, doing business as Capstone Insurance (“Capstone,” “we,” “us,” or “our”). By using these services, you agree to these Terms. If you do not agree, do not use them.
1. Insurance Agency Services
Capstone is an independent insurance agency. We assist customers with obtaining insurance quotations, submitting applications, servicing policies, and communicating with insurers and other insurance-market participants. Capstone is not an insurance company and does not itself underwrite, issue, or guarantee insurance coverage. Availability, eligibility, pricing, coverage, and policy terms are determined by the applicable insurer and the issued policy.
Information on our website or in our communications is general in nature and is not legal, tax, financial, or insurance advice for any particular situation. Any summaries or descriptions of coverage are illustrative only. The actual insurance policy, including its declarations, forms, endorsements, exclusions, conditions, and limits, controls in the event of any difference.
2. No Coverage Bound or Changed Electronically Without Confirmation
Submitting a website form, application, email, voicemail, or text message does not bind insurance coverage and does not create, renew, amend, replace, or cancel a policy. Coverage or a policy change is effective only when confirmed by Capstone or the applicable insurer through an authorized written binder, endorsement, policy, cancellation notice, or other formal confirmation. Do not assume a request has been completed until you receive confirmation.
Do not use our website, email, or text messaging for emergencies, urgent claims, time-sensitive coverage changes, or cancellation requests. If immediate assistance is required, call our office or the applicable insurer directly. In an emergency, call 911.
3. Quotations and Applications
Quotes are estimates based on the information available when prepared and are subject to underwriting review, verification, inspection, consumer reports where legally permitted, and insurer approval. Premiums and terms may change. You agree to provide complete and accurate information and to promptly correct any errors or changes. Material omissions or misrepresentations may affect pricing, eligibility, coverage, or claim handling.
4. Electronic Communications
By contacting us electronically, you consent to receive responsive communications through the channel you used or another channel you have authorized. Email and standard text messaging are not guaranteed to be secure. Do not send Social Security numbers, payment-card numbers, medical information, or other highly sensitive information through ordinary email, website text fields, or SMS unless we provide a secure method.
5. Capstone Insurance Text-Messaging Program
Program name: Capstone Insurance Messaging.
Program description: With your consent, Capstone may send text messages concerning insurance quotes and applications, requests for information or documents, appointment and renewal reminders, policy service, billing or claim-related follow-up, account notifications, and customer-support conversations. Capstone does not use this program for unsolicited promotional text campaigns.
Opt-in: You may opt in by initiating a text conversation with us or by verbally requesting or agreeing to receive text messages during a telephone or in-person conversation. Capstone personnel may document consent in the agency’s client-management system. Providing a telephone number alone does not constitute consent.
Message frequency: Message frequency varies based on your requests, quote activity, and policy needs.
Charges: Message and data rates may apply. Your wireless carrier’s terms and charges govern your use of text messaging.
Opt-out: Reply STOP to any Capstone text to stop texts from that number. We may send one final message confirming your opt-out. Other recognized opt-out words may also be honored. Your opt-out does not prevent Capstone from communicating with you by non-SMS methods when permitted or required. You may later opt in again through an approved method.

Carrier responsibility: Wireless carriers are not liable for delayed or undelivered messages. Delivery is subject to network availability and cannot be guaranteed.
Eligibility: You must be at least 18 years old and the subscriber or customary user of the mobile number provided, or otherwise authorized to consent for that number.
Privacy: We handle information obtained through our messaging program as described in our Privacy Policy. Mobile opt-in data and consent will not be shared with third parties or affiliates for their marketing or promotional purposes.
6. Permitted Use
You may use our website and communication services only for lawful purposes. You may not interfere with their operation, attempt unauthorized access, introduce malicious code, use automated means to scrape content, impersonate another person, submit false information, or use the services in a manner that violates law or the rights of others.
7. Third-Party Services and Links
Our services may link to or integrate with insurers, payment processors, comparative raters, customer portals, claims services, and other third parties. Capstone does not control and is not responsible for third-party websites, systems, content, availability, security, or privacy practices. Your use of third-party services is governed by their own terms and policies.
8. Intellectual Property
The website and its original text, design, graphics, logos, and other content are owned by or licensed to Capstone and are protected by applicable intellectual-property laws. You may use the website for personal, noncommercial insurance-related purposes but may not reproduce, distribute, modify, or exploit its content without prior written permission, except as permitted by law.
9. Disclaimer of Warranties
To the fullest extent permitted by law, the website and electronic communication services are provided on an “as is” and “as available” basis. Capstone does not warrant that they will be uninterrupted, error-free, secure, or free of harmful components, or that all information will always be complete or current. Nothing in these Terms excludes warranties or rights that cannot lawfully be excluded.
10. Limitation of Liability
To the fullest extent permitted by law, Capstone and its owners, employees, and representatives will not be liable for indirect, incidental, special, consequential, or punitive damages arising from use of, or inability to use, the website or electronic communication services. This limitation does not apply where prohibited by law and does not alter any duties Capstone has under applicable insurance laws or a separate written agreement.
11. Privacy
Our Privacy Policy explains how we collect, use, disclose, and protect personal information and is incorporated into these Terms by reference.
12. Governing Law
These Terms are governed by the laws of the State of Maryland, without regard to conflict-of-law principles. Any dispute relating to these Terms or the website will be brought in a court of competent jurisdiction in Maryland, unless applicable law requires otherwise.
13. Changes to These Terms
We may revise these Terms from time to time. The updated Terms will be posted on our website with a new effective date. Continued use after the revised Terms take effect constitutes acceptance of the revised Terms, to the extent permitted by law.
